Noise Labs, Inc. (“Noise,” “we,” “us,” or “our”) is dedicated to protecting the privacy of your personal data. This Privacy Policy explains what personal data we collect on our websites and related services (each, a “Site” and collectively our “Sites”); how we use it; and how we share it. It incorporates the Terms of Service found on our Sites and applies only to our Sites (not third-party products or services).

1. Personal Data We Collect

“Personal data” means individually identifiable information collected online and maintained in an accessible form. It does not include aggregate or other non-identifiable information.

a. Personal data you provide us

Examples include contact information, account details, social handles (e.g., X), wallet addresses, and trade activity (long/short, size, leverage, margin, timestamps, liquidations, past orders).

b. Personal data collected automatically

  • Browser and device data: e.g., IP, device IDs, OS/browser, screen resolution, language.
  • Usage data: e.g., pages viewed, time on Site, referrers, links clicked, and cross-site activity over time.

c. Personal data we collect from others

  • Service providers (hosting, analytics, support, identity verification, chat tools).
  • Social/content platforms (e.g., Google, X, MetaMask, Rabby, OKX Wallet, WalletConnect).
  • Other third parties (business/marketing partners, ad networks, advertisers).

2. Use of Personal Data

  • Provide, operate, maintain, improve, personalize, and expand the Sites.
  • Customer support; new features; communications (including marketing per preferences).
  • Security, fraud prevention, legal compliance, internal analytics, targeted advertising, and M&A activities.

  • Personalize/measure/improve marketing (where permitted).

6. Children’s Data

Sites are not intended for children under 18; we do not knowingly collect such data.

7. Data Security and Retention

We maintain appropriate safeguards but cannot guarantee absolute security. We retain personal data as needed for the purposes outlined, legal obligations, dispute resolution, and enforcement, considering relationship length, legal duties, and our legal position.

8. Transfers of Personal Data

Your data may be transferred to and processed in the United States with appropriate safeguards.

9. Your Privacy Choices

A. Opting out of Marketing Communications

Unsubscribe via email links or email privacy@noise.xyz. For SMS, reply “STOP” (or “HELP” for help).

B. Account Deletion

Email privacy@noise.xyz. Certain data may be retained for legal, security, fraud prevention, and unsubscribe purposes; we may retain de-identified/aggregate data.

10. Notice to Individuals in the EEA, UK, and Switzerland

Rights include access, erasure, rectification, object, restrict, portability, withdraw consent, and lodge a complaint.

11. Notice to Individuals in Canada

Rights include access, correct, and withdraw consent (subject to legal/contractual limits). Contact privacy@noise.xyz. You may also contact the Office of the Privacy Commissioner at (800) 282-1376.

12. Notice to Individuals in Australia and New Zealand

Rights include access and correction (subject to exceptions). Requests are subject to verification and legal exceptions.

13. Notice to Residents of the Philippines

Rights include access, correction, suspend/withdraw/delete, object, withdraw consent, and file a complaint with the National Privacy Commission: www.privacy.gov.ph.

14. Notice to Residents of Brazil

LGPD rights include confirmation/access, rectification, erasure (where based on consent), anonymization/blocking/deletion of unnecessary/excessive/non-compliant data, objection, portability (in certain cases), withdraw consent, and petition to the DPA.

15. Updates to this Privacy Policy

We may update this Policy; changes are effective when posted. We may notify via email and/or prominent Site notice.
